General Terms and Conditions of Dying Pride

§1 Scope and Definitions

(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities (§ 13 BGB).

§2 Conclusion of Contract and Storage of Contract Text

(1) The following provisions apply to orders placed through our online store.

(3) The presentation of products in our online store does not constitute a legally binding offer, but rather a non-binding invitation for consumers to order goods. By placing an order for the desired item, the consumer makes a binding offer to enter into a purchase contract.

(4) The ordering process in our online store consists of the following steps:

1. Selection of the desired item(s)
2. Confirmation by clicking the “Order” button
3. Reviewing the shopping cart details
4. Clicking the “Checkout” button
5. Registering in the online store and entering login details (email address and password)
6. Reviewing and correcting any entered data
7. Submitting a binding order by clicking the “Buy Now” button

Consumers can correct input errors before submitting the order using the “Back” button in their browser or cancel the ordering process by closing the browser. We confirm receipt of the order immediately with an automatically generated email (“Order Confirmation”). This constitutes acceptance of the offer.

(5) Storage of contract text: We store the contract text and send you the order details along with our terms and conditions via email. You can access your past orders in our customer area under “My Account” → “My Orders.”

 

§3 Prices, Shipping Costs, Payment, Due Date

(1) All prices are shown in CHF/EUR and do not include VAT unless stated otherwise. Import taxes or duties may apply depending on your country.

(2) Consumers can pay via PayPal or credit card (Visa, Mastercard, American Express).

§4 Delivery

(1) Unless otherwise clearly stated in the product description, all offered items are ready for immediate dispatch. Delivery will take place within a maximum of 5 business days. The delivery period begins, in the case of prepayment, the day after the payment order has been issued to the bank, and for all other payment methods, the day after contract conclusion. If the end of this period falls on a Saturday, Sunday, or public holiday at the delivery location, the deadline is extended to the next business day.

(2) The risk of accidental loss or deterioration of the purchased item passes to the buyer upon handover of the goods.

§5 Retention of Title

The goods remain our property until full payment has been received.

§6 Consumer Right of Withdrawal

Right of Withdrawal

Consumers have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

by means of a clear statement (e.g., by mail or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a non-standard delivery method), promptly and no later than fourteen days from the day we receive your withdrawal notice. Refunds will be made using the same payment method used for the initial transaction unless expressly agreed otherwise; no fees will be charged for this reimbursement.

We may withhold reimbursement until we have received the returned goods or until you provide proof of return, whichever is earlier.

You must return the goods promptly and in any event no later than fourteen days from the date you inform us of the withdrawal. The deadline is met if you send the goods before the fourteen-day period expires.

You bear the direct cost of returning the goods.

§8 Warranty

The contract language is English. A German version is available for reference purposes only and is not legally binding.
